Terms and conditions
Last updated: 16 Oct 2026
Terms of use and sale for the children’s app NixTier and the website nixtier.ai-design-thinking.de. The German version is authoritative.
1. Provider and contractual partner
NixTier is offered by Victor von Rautenberg, Pfarrer-Theile-Str. 97, 13591 Berlin, Germany, e-mail: admin@ai-design-thinking.de. He is also your contractual partner for all purchases.
2. Scope
These terms apply to the use of the NixTier app and this website and to the purchase of packs (extras) for NixTier.
3. The app
NixTier is a children’s app for Android; download and basic game are free of charge. No account is needed.
4. Packs and prices
On the purchase page you can buy permanent unlocks: animal friends, colours & accessories and more games individually, or everything together. The prices shown there apply. All prices are final prices. In accordance with § 19 UStG (German VAT Act), no value added tax is charged. There is no subscription, no in-game currency and no random content.
5. Who may buy
Only adults may buy, as parents or legal guardians, for use in their household.
6. Conclusion of contract
On the purchase page you choose a pack, enter your e-mail address and confirm the terms, that you are of age, your consent to immediate performance and your acknowledgement of losing the right of withdrawal. You are then taken to the payment page of our payment service provider Stripe. There you can see the product and price and can check and correct your entries. Above the button it says: “By clicking ‘Pay’ you place an order with an obligation to pay.” By clicking “Pay” you submit a binding order; the contract is concluded upon successful payment.
We do not store the contract text separately: you can access and save these terms at any time on this page, and you will receive the confirmation of the contract by e-mail. The contract language is German; these terms are additionally available in English, and the German version prevails.
7. Payment
Payment is processed by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland. Depending on what is offered on the payment page, you can pay by card, PayPal, Apple Pay, Google Pay or Klarna.
8. Delivery and unlock code
Immediately after payment you receive by e-mail an unlock code with a link and QR code, together with the confirmation of the contract. With the code you unlock the pack in NixTier (parent area › Extras). The code is not tied to a device. It is intended for the devices of your household and must not be passed on to third parties or published. Please keep it; you can request it again at any time under Resend code.
9. Blocking
If a payment is refunded or charged back, or if a code is passed on or published contrary to section 8, we may block the code. The app then removes the unlock at the next synchronisation; pet, name and care remain.
10. Right of withdrawal
As a consumer, you have a statutory right of withdrawal. Details and the model withdrawal form can be found in the information on the right of withdrawal.
You can also declare the withdrawal using the Withdraw from contract button. You will find it in the footer of every page, in the information on the right of withdrawal and in the e-mail with the unlock code.
The right of withdrawal expires early if, before the purchase, you have expressly consented to our beginning performance of the contract before the withdrawal period has expired and have acknowledged that you thereby lose your right of withdrawal (§ 356(5) BGB (German Civil Code)). The purchase page obtains this consent and acknowledgement.
11. Digital content and defects
NixTier provides digital content with the functions described in the app and on this website. There is no entitlement to further functions. In the event of defects, the statutory rights for digital products apply (§§ 327 et seq. BGB).
12. Availability and changes
We endeavour to ensure trouble-free operation but cannot guarantee permanent availability of the servers. We may further develop the app and change functions insofar as this is reasonable for you; § 327r BGB remains unaffected.
13. Liability
We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under the Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, we are liable only for the breach of essential contractual obligations, that is, obligations whose fulfilment is a prerequisite for the proper performance of the contract in the first place and on whose observance you may regularly rely; in this case, liability is limited to the foreseeable damage typical for this type of contract. In all other respects, liability is excluded.
14. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
15. Applicable law
German law applies. If you are a consumer, the mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.
